PROTECTING THE MEANING AND VALUE OF AMERICAN CITIZENSHIP

The Executive Order establishes a policy to restrict the automatic recognition of United States citizenship for individuals born in the United States under certain circumstances. Specifically, it excludes from birthright citizenship persons born in the United States whose mother was unlawfully present in the country at the time of their birth, unless their father was a U.S. citizen or lawful permanent resident. It also excludes those born to mothers who were visiting on a temporary visa.

The order instructs various federal agencies to issue guidance and ensure consistency with its provisions within 30 days, including the Secretary of State, Attorney General, and heads of executive departments. The order clarifies that it does not affect the entitlement of other individuals, such as children of lawful permanent residents, to obtain documentation of their U.S. citizenship. It also states that nothing in the order affects existing law or creates new rights or benefits enforceable at law.
